Proposed State Energy Regulation

Regulations implementing California's benchmarking and public disclosure program for certain building became effective on March 1, 2018. June 1, 2018 is the first deadline under the regulations which requires the submission of 2017 building energy use benchmarking data to the California Energy Commission for buildings with more than 50,000 square feet of gross floor area and no residential utility accounts. As reported in our article on 2017 California Legislative Developments Affecting Commercial Real Property, the California Energy Department has been in a rulemaking process since early 2016 with respect to the implementation of California Assembly Bill 802. That bill required utility companies to provide certain information to owners and operators of buildings covered by the legislation and required the California Energy Commission to establish a benchmarking and public disclosure program for certain buildings. Proposed regulations implementing AB 802 were submitted on February 23, 2017 and are in a comment period with a public hearing scheduled for July 12, 2017. A summary of the final regulations will be posted when available.

City of Los Angeles Energy Regulations

In a related development, the City of Los Angeles has adopted benchmarking, reporting and publication requirements for energy and water, applicable to designated commercial buildings in the City effective January 29, 2017. The ordinance also requires energy and water audits and retro-commissioning in accordance with industry standards.
